§ 8-28. Barking dogs and crying cats.

  • (a)

    It shall be unlawful for any person knowingly to keep or harbor any dog which habitually barks, howls or yelps, or any cat which habitually cries or howls to the great discomfort of the peace and quiet of the neighborhood or in such manner as to materially disturb or annoy persons in the neighborhood who are of ordinary sensibilities. Such dogs and cats are hereby declared to be a public nuisance. The town constable shall determine if a dog or cat is in violation of this section and shall issue a warning or citation dependent upon the severity and regularity of the offense. A dog or cat is considered to be in violation of this section when three formal, written complaints are filed with the town within any one 60-day period; the town may send a notice of complaint to the harborer of a barking dog after one written complaint.

    (b)

    No person shall be found to be in violation of this section unless first notified in writing, at least ten days prior to the issuance of any citation or summons, of the fact of the complaints of noise.
